Please read these Terms of Service (“Terms”) carefully before using SafeFanControl. These Terms cover two distinct things:
- “the Site” (also “this website”) — the website at safefancontrol.com, including all of its pages and content.
- “the Software” (also “the App”) — the SafeFanControl macOS application.
By accessing the Site, or by downloading or using the Software, you agree to these Terms. Where a provision refers specifically to the Site or specifically to the Software, it applies only to that thing; where it refers to both, it applies to both.
1. Acceptance of Terms
By accessing the Site, or by installing, accessing, or using the Software, you confirm that you have read, understood, and agree to be bound by these Terms. If you do not agree, do not use the Site or the Software.
2. License Grant
Subject to your compliance with these Terms, the developer grants you a limited, non-exclusive, non-transferable, revocable license to:
- Install and use SafeFanControl on Mac computers that you personally own or control.
- Use the Software for personal, non-commercial purposes.
This license does not permit:
- Redistribution, resale, or sublicensing of the Software.
- Reverse engineering or decompiling the Software beyond what is permitted by applicable law.
- Use of the Software in commercial fleet environments without a separate commercial agreement.
3. Free and Paid Tiers
Monitor mode is free and provided at no charge indefinitely.
Fan control features require a paid license. A 14-day trial is available without payment. After the trial period, continued use of these features requires a valid license key.
License keys are perpetual and personal. One license covers all Mac computers under your personal ownership.
4. Payment Terms
Payment for the full license is a one-time charge processed at the time of purchase. The price shown at checkout is the total amount charged. All prices are displayed in USD.
Payments are processed through a third-party payment processor. By completing a purchase, you agree to their applicable terms. The developer does not store your payment card details.
Upon successful payment, a license key will be issued and delivered to the email address you provide at checkout. Keep your license key safe — it is your proof of purchase and is required to register the Software on any device.
5. Refund Policy
Because we respect your privacy, SafeFanControl uses an offline registration system. Once a license key is issued, it cannot be remotely deactivated or invalidated. For this reason, all sales are final and we cannot issue standard refunds.
We strongly encourage you to use the 14-day free trial before purchasing to confirm that the app meets your needs and is fully compatible with your hardware and macOS version.
Exception — permanent macOS compatibility failure: If an Apple macOS update permanently disables the underlying methods used for fan control (i.e., no working release or workaround becomes available within a reasonable timeframe), we will issue a full refund for licenses purchased within the 30 days prior to that update’s release. Please note that if a compatible update or workaround is later released, a license that has already been refunded under this exception will remain permanently invalid.
To request an exception refund, contact us at Contact with your license key and proof of purchase.
6. Hardware Interaction & Risk Acknowledgement
SafeFanControl interacts with low-level hardware interfaces (SMC keys) to control fan speeds. By using the Software:
- You acknowledge that fan control is hardware-adjacent and carries a small risk of unexpected behaviour on specific hardware configurations.
- You acknowledge that you have reviewed the Fan Test Wizard and confirmed compatibility before relying on the Software for real workloads.
- You understand that the failsafe design (“give control back to Apple”) does not guarantee protection against all hardware edge cases.
- You accept sole responsibility for any use of the Software on hardware not listed as supported.
7. Intellectual Property
The Software and the Site, together with all associated materials — including but not limited to source code, graphics, documentation, the content and design of the Site, and the SafeFanControl name — are the exclusive intellectual property of the developer and are protected by applicable copyright and intellectual property laws.
These Terms do not transfer any ownership rights to you. All rights not expressly granted herein are reserved by the developer.
8. Disclaimer of Warranties
THE SOFTWARE AND THE SITE ARE PROVIDED “AS IS”, WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
The developer does not warrant that:
- The Software or the Site will be uninterrupted, available, or error-free.
- The Software will be compatible with all future macOS versions.
- The Software will produce any specific thermal or fan behaviour on your hardware.
9. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, THE DEVELOPER SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES — INCLUDING BUT NOT LIMITED TO HARDWARE DAMAGE, DATA LOSS, OR LOSS OF PROFITS — ARISING FROM YOUR USE OR INABILITY TO USE THE SOFTWARE OR THE SITE.
In no event shall the developer’s total liability exceed the amount you paid for the Software in the twelve (12) months preceding the claim.
10. Apple Inc. Disclaimer
SafeFanControl uses a non-public SMC key sequence to interact with fan hardware — the same technique used by other respected community tools. This interaction is not endorsed or supported by Apple Inc. Apple, macOS, Apple Silicon, and related marks are trademarks of Apple Inc.
Your use of SafeFanControl does not imply any endorsement by, or affiliation with, Apple Inc.
11. Updates and Compatibility
The developer may release updates from time to time. Paid license holders receive all compatibility and bug-fix updates at no additional charge. The developer reserves the right to discontinue support for older macOS versions with reasonable notice.
12. Termination
Your license terminates automatically if you violate these Terms. Upon termination, you must cease using and delete all copies of the Software.
13. Governing Law
These Terms are governed by the laws of China, without regard to its conflict-of-law provisions. Any dispute arising under or relating to these Terms shall be subject to the exclusive jurisdiction of the courts located in that jurisdiction.
14. Severability
If any provision of these Terms is found to be unenforceable or invalid under applicable law, that provision will be limited or eliminated to the minimum extent necessary, and the remaining provisions will continue in full force and effect.
15. Entire Agreement
These Terms, together with the Privacy Policy, constitute the entire agreement between you and the developer with respect to the Site and the Software, and supersede all prior or contemporaneous agreements or understandings, whether written or oral.
16. Changes to These Terms
The developer reserves the right to modify these Terms at any time. Continued use of the Site or the Software after changes are posted constitutes acceptance of the revised Terms. The “Last updated” date at the top reflects the most recent revision.
Privacy Policy
Our full Privacy Policy is available at safefancontrol.com/privacy/. In short: the app makes no network connections during normal operation (the only exception being the optional alert notification webhook, which connects solely to the endpoint you configure). The only personal information we ever receive is the purchase information passed to us by our Merchant of Record, Waffo Pancake, which we use solely to generate and deliver your license key.
